Foshan Gongzheng has won two cases in the patent dispute with Nissei ASB, receiving support by the Supreme Court and achieving victory

The disputes arose from molds provided by Foshan Gongzheng to “Company A” (which had purchased ISBM machine from ASB and was recommended by ASB staff to custom-order molds compatible with its machine from Foshan Gongzheng). The disputes involved three cases, two of which concerned the core component of the mold, the base mold (Cases 351 and 353, involving patent numbers ZL201280051388.8 and ZL201610342452.7 respectively). The Supreme People’s Court supported Foshan Gongzheng, recognizing that the company holds independent intellectual property rights for the related products and did not infringe on patents, thus ruling in favor of Gongzheng. Another case involved a neck mold (Case 448, involving patent number ZL201410377478.6), where the innovation of the patent was relatively simple, concerning only “a reinforcing shaft passing through the support structure of N columns of retaining plates,” and the corresponding structure accounted for less than 3% of the entire mold. Although Foshan Gongzheng expressed slight regret over the court’s decision that this case constituted equivalence, we still supports and respects the court’s judgment and has fully complied with the obligations set forth in the judgment.

As a leading national enterprise in the manufacture of high-capacity “one-step injection stretch blow molding” equipment, Foshan Gongzheng consistently adheres to independent innovation, investing significant human and material resources annually in product development, and has obtained multiple patents with complete independent intellectual property rights. Currently, the “one-step injection stretch blow molding equipment and molds” sold by Foshan Gongzheng possess independent intellectual property rights and are not restricted by others’ intellectual property rights. The production, sale, and use of related equipment and molds are unaffected.

In these disputes, Foshan Gongzheng expressed confusion and incomprehension regarding Nissei ASB’s action of listing its significant client, Company A, and Gongzheng as co-defendants. In response, Foshan Gongzheng makes a public commitment: Foshan Gongzheng will always adhere to independent innovation, always respect any intellectual property rights of others, and will never use intellectual property rights to sue any of its clients.
